Why Is My BWC Claim Going to the Court of Common Pleas?

If your claim is heard before the Industrial Commission of Ohio on any matter, which can be the issue of an original allowance of a claim or the allowance of an additional conditions/diagnosis, the Employer or the Injured Worker may appeal a decision of the Industrial Commission to the Court of Common Pleas in the county in which the injury occurred.
 
If your Employer is a state fund employer, generally that court appeal will involve the Ohio Attorney General's Office, which represents the OhioBWC.
 
If your Employer is a self insured, it will retain its own attorney to prosecute the appeal in court.
 
The employer and the injured worker are responsible for retaining their own legal representation. If the parties do not agree to a settlement of the claim, a jury trial will be scheduled.
